1. AI Voice Notice
GetCall utilizes automated artificial intelligence voice software to handle incoming business calls. By using our service, you acknowledge that callers will interact with an AI voice agent, not a human receptionist. You agree to ensure that all necessary disclosures are made to end users regarding the use of automated AI technology during calls.
2. Call Recording Consent & Compliance
The subscribing business or client bears sole responsibility for enabling, implementing, and maintaining all legally required call-recording consent disclaimers in accordance with local, state, and federal wiretapping laws. This includes but is not limited to:
- Providing appropriate caller notifications (e.g., "This call may be recorded for quality and training purposes")
- Complying with all two-party consent jurisdiction requirements
- Obtaining and maintaining proper disclosure agreements where required by law
- Handling opt-out requests as mandated by applicable regulations
GetCall is not responsible for legal non-compliance related to call recording, disclosure, or consent violations.
3. HIPAA & Healthcare Non-Compliance
GetCall is a scheduling and call-routing automation platform. GetCall is not a HIPAA-compliant system and does not serve as an electronic health record (EHR) or medical record storage solution. If your practice handles Protected Health Information (PHI), you are responsible for:
- Implementing separate HIPAA-compliant systems for storing and managing patient medical records
- Ensuring that no PHI is transmitted through or stored in GetCall systems
- Maintaining Business Associate Agreements (BAAs) with appropriate vendors for any PHI handling
GetCall may not be used as your primary or sole means of health information management.
4. Emergency Services Not Supported
GetCall does not handle emergency calls and is not equipped to provide emergency services. All emergency calls must be directed to 911. The AI system is designed only for routine business inquiries, appointment scheduling, and general information requests. You must ensure that callers are able to reach emergency services directly and that your forwarding setup does not impede access to 911.
5. No Long-Term Contracts
GetCall operates on a month-to-month billing cycle with no mandatory long-term contracts. You may cancel your service before your next billing cycle without penalty. Cancellation requests must be submitted in writing to support@getcall.co.
6. Billing & Cancellation
- Monthly plans renew automatically on the same date each month
- Setup fees ($800) are non-refundable once service is provisioned
- Monthly subscription fees are prorated if you cancel mid-cycle, per our standard policy
- You are responsible for providing accurate billing and contact information
7. Service Limitations
GetCall is designed for appointment booking, call routing, and general business inquiry handling. The service is not suitable for:
- Emergency response or crisis management
- Medical diagnosis or treatment recommendations
- Handling sensitive personal, financial, or health information
- High-volume transaction processing or complex multi-step workflows beyond our scope
8. Liability & Disclaimers
To the maximum extent permitted by law, GetCall and its owners are not liable for:
- Lost calls, missed appointments, or communication failures
- Damages resulting from non-compliance with local, state, or federal law
- Misuse of the service or failure to maintain required legal disclosures
- Indirect, incidental, or consequential damages arising from service use
9. User Responsibilities
By using GetCall, you agree to:
- Comply with all applicable federal, state, and local laws and regulations
- Maintain all required disclosures and consent notices for your jurisdiction
- Use the service only for lawful, legitimate business purposes
- Not use the service to harass, deceive, or defraud callers
- Assume responsibility for the content and legality of your AI agent's responses
10. Changes to Terms
GetCall reserves the right to update these Terms of Service at any time. Material changes will be communicated via email or notice on our website. Your continued use of the service constitutes acceptance of updated terms.
